Benjamin Hillner

graduated from the College of the Holy Cross in Worcester, Massachusetts, where he was a member of the rowing team and staff writer for the college newspaper. He graduated from the Villanova University School of Law, where he was an active member of the Pro Bono Society and in student politics.

He was commissioned a First Lieutenant in the U.S. Army Judge Advocate General’s Corps (JAG). He began his military career as a legal assistance attorney and military magistrate before assuming duties as a prosecutor at Fort Benning, Georgia, and Joint Base Elmendorf-Richardson, Alaska, prosecuting charges from larceny and drug use to murder.

Mr. Hillner deployed to Afghanistan in support of Operation Enduring Freedom and served as the principal operational law advisor for the 4th Brigade (Airborne) 25th Infantry Division. Mr. Hillner thereafter left Alaska for duties as a trial defense counsel at Joint Base Lewis-McChord (JBLM), Washington, where he represented Soldiers at all levels of administrative and criminal investigation, to include those that received letters of reprimand to others charged with violations of Article 120 of the UCMJ and capital murder.

Before joining Court & Carpenter, the U.S. Army selected Mr. Hillner to serve as the Senior Training Officer for the Trial Counsel Assistance Program (TCAP), where he oversaw training and trial strategy for U.S. Army prosecutors worldwide. In sum, Mr. Hillner offers every client an inordinate wealth of professional experiences coupled with a keen sense of all government prosecutions gathered from his prior institutional knowledge. Mr. Hillner is admitted to practice before the Supreme Court of Pennsylvania and the Supreme Court of the United States. He is a member of the Pennsylvania Bar Association, the American Bar Association, the National Association of Criminal Defense Lawyers, and the Military Officers’ Association of America. Mr. Hillner is a Major in the U.S. Army Reserve.

Few civilian firms offer the proverbial "inside track" on military sex assault prosecutions like Court & Carpenter. The U.S. Army once hand-selected Ben Hillner to painstakingly lecture and train scores of military prosecutors on trial advocacy techniques in sexual assault cases. Now, two years later, Ben has joined the defense team at Court & Carpenter in order to provide invaluable insights on how to succeed against many of these very same prosecutors.
